Welcome to a course with the experts Rasmus Josefsson and Daria Kozlowska-Rautiainen.A course in arbitration essentials for anyone with little or no experience in the field who may come across arbitration in one way or another. The course will be held in English hence it will also be perfect for anyone not natively Swedish who wants to learn about arbitration fundamentals from a Swedish perspective.

Most arbitration courses, conferences and seminars are aimed at external counsel - dispute resolution specialists. The users of arbitration, for example the company representative who make the strategical decisions or is responsible for administrating the evidence in the face of a dispute or are involved in or the in-house counsel drafting the arbitration clauses are rarely the main target groups.

Our course fill-in that void as it targets also those who do not necessarily regularly represent clients in arbitration, but still want to know more about what arbitration is and how it can be efficiently used to resolve disputes.

Some of the questions that will be discussed are: 

  • What are the typical steps of an arbitration proceeding and how long can it take to resolve a dispute?
  • What are the advantages and disadvantages of arbitration compared to court proceedings and other means of resolving disputes?
  • How much does it cost, who pays for the costs and when?
  • What are the effects of the arbitral award compared to a court judgment and settlement agreement?
  • What can you do as a party to an arbitration to increase your chances of success and to help your counsel?

What arbitration agreement states can feel not as important compared to the other clauses in the contract, but at the time when a dispute arises, it becomes all important. Therefore, the course will also focus on the important considerations regarding the arbitration agreement, like the choice of the seat, rules and the specific phrases to use and those to avoid.

To summarize, the course aims at helping people that use arbitration as means to resolve disputes (or perhaps want to) to make more informed decisions, consider the risks and opportunity better and predict how disputes are resolved by arbitration in practice.

The course will deal with the following:

  • The drafting of an arbitration agreement.
    - Common pitfalls with arbitration agreements,
    - What to consider when drafting the agreement - ad hoc vs. institutional arbitration, arbitration seat, number of arbitrators, etc.
  • Choice of law – how does the applicable law affect the proceedings?
  • The arbitration procedure and strategical issues;
    - What to consider when choosing arbitrators?
    - How does document production work?
    - Witness testimony
    - Who pays the costs for the proceedings and when?
  • The effects of the arbitral award.
    - Advantages/disadvantages to a court judgment.
    - What can you do with the arbitral award when you win? And what can you do when you lose?
  • How to draft effective arbitration agreements.
  • How to make informed decisions before and during arbitration proceedings.
  • The essential elements of an arbitral proceeding.
  • Some ways to increase your chances of success in arbitrations.

Kursledare

Rasmus Josefsson är verksam som advokat vid Werks Advokater i Göteborg där han huvudsakligen arbetar med kommersiell tvistlösning och företräder klienter i svenska och internationella skiljeförfaranden samt i domstolsprocesser. Han har ett stort intresse för processrätt i allmänhet och skiljerätt i synnerhet och har publicerat flera artiklar inom området. Han är även medförfattare till boken "Skiljeförfarande – en introduktion". I Avtalsguiden skriver Rasmus Josefsson inom området skiljeförfarande och ADR.

Daria Kozlowska-Rautiainen, jur. dr. från Helsingfors universitet, arbetar som universitetslektor vid juridiska fakulteten vid Stockholms universitet där hon undervisar på magisterprogrammet i internationell kommersiell skiljedomsrätt. Hon har erfarenhet från advokatbyråer i Polen, Österrike och Finland. Hon har även varit praktikant på ICC i Paris. Daria har varit styrelseledamot i Young Arbitrators Club i Finland och är redaktör för en av de ledande affärsjuridiska tidskrifterna i Finland - Liikejuridiikka
